Term and Conditions

1. Definitions

In these Terms and Conditions (“Terms”):
· “Halotel” means Viettel Tanzania Public Limited Company, providing 5G Fixed Internet services.
· “Customer” or “Subscriber” means any individual or entity who subscribes to and uses Halotel’s 5G Fixed Internet service.
· “Service” refers to Halotel’s 5G Internet access provided through a CPE (Customer Premises Equipment) router and SIM card.
· “CPE Router” means the Halotel-supplied 5G router configured for fixed home or office use.
· “Activation Date” means the date on which the service is first connected and made available for use to the customer.
· “Registered Service Location” means the physical location approved by Halotel for the use of the 5G Service.

2. Applicability

These Terms and Conditions apply to all customers using Halotel’s 5G Fixed Internet Service. By activating or using the Service, the customer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

3. Relationship with General Terms and Conditions

These Terms and Conditions shall be read together with Halotel’s General Subscriber Terms and Conditions, which apply to all Halotel customers.
In the event of any inconsistency or conflict between these Terms and the Halotel General Subscriber Terms and Conditions, the provisions of these Terms and Conditions shall prevail with respect to the 5G Fixed Internet Service.
Copies of Halotel’s General Subscriber Terms and Conditions are available at all Halotel Shops and on the official Halotel website.

4. Service Commitment

a. The Service shall commence on the Activation Date and continue for identified duration of the selected package from that date unless renewed by the customer.
b. The Service is provided as a fixed internet solution intended for use at the customer’s registered location only
c. The Halotel 5G Fixed Internet Service is a prepaid service. Customers are required to make payment in advance to activate or renew access for each 30-day service period. The Service will remain inactive until payment for the selected package is made.

5. Activation and Service Usage

a. Customers subscribing to Halotel 5G Fixed Internet shall receive:
i) One 5G-enabled CPE router; and
ii) A dedicated SIM card configured exclusively for the device.
b. The Service connection remains active identified duration of the selected package from the initial activation date, after which renewal is required to continue access.
c. In the first month, customers will receive the CPE router bundled with 30 days of internet access
d. The CPE router and its associated SIM card are network-locked for exclusive operation within the Halotel network. Furthermore, service usage is subject to geographic restrictions based on the registered installation location.
e. Connection of multiple users is supported; however, actual experience depends on signal strength, network congestion, and device limitations.
f. The router device shall remain the property of Halotel for a period of twelve (12) months from the activation date. During this period, the customer is required to maintain continuous monthly subscriptions to the Service.
g. Full ownership of the CPE router shall transfer to the customer after twelve (12) months of active subscription (counting months in which payment has been made). If the service is discontinued before this period, ownership remains with Halotel and the router must be returned.
h. Since the Service operates on a prepaid basis, the customer shall only have access to the Internet upon active subscription to a package.
i. If a customer fails to make any payment for six (6) consecutive months within the first twelve (12) months from activation, they shall lose eligibility to retain the CPE router and must return it to Halotel.
j. Failure to return the router within fourteen (14) days after the service cancellation shall attract a non-return fee of TZS 200,000, payable to Halotel.

 

Upon subscription to any data bundle, the Company may temporarily reserve a portion of the Customer’s active bundle to ensure session continuity (“reserve volume”) upon bundle depletion and re-subscription, with the reserved volume dynamically calculated based on the registered package, customer tier and customer’s usage trends

6. Fair Usage Policy

a. Halotel reserves the right to manage network resources to ensure fair access for all users.
b. Continuous or excessive usage that negatively affects network performance or other customers’ experience may lead to speed reduction (throttling) or temporary service suspension.
c. The Halotel 5G Internet Service is intended for personal, household, or small business use only, and may not be resold, redistributed, or used for unauthorized commercial activities.
d. Each 5G Fixed Internet package is subject to a Fair Usage Policy (FUP) specifying the maximum data volume available per package. Once the specified data volume is consumed, the connection speed may be reduced until the next renewal.
e. Details of the data volumes and related fair usage limits for each package shall be disclosed in the individual customer contract signed upon subscription.

7. Coverage and Network Performance

a. The Service is available only within areas covered by Halotel’s 5G Fixed Internet Network.
b. Halotel shall not be liable for failure to provide service in areas outside of 5G coverage or where network access is interrupted due to technical or environmental factors.
c. If the customer relocates from the registered service location to an area without 5G coverage, connectivity may automatically fall back to available 4G or 3G networks, if technically supported.
d. Network speed and performance may vary depending on factors such as signal strength, number of users, network congestion, device quality, and line-of-sight to the serving tower.

8. Restrictions of Use

a. The 5G SIM card provided with the CPE router grants access to data and SMS services only. Voice services are disabled.
b. The Halotel 5G Internet SIM card shall not be used for:
i) International bypass or Voice-over-IP termination; or
ii) Any activity that violates Halotel’s network integrity, the law, or regulatory directives.
c. Breach of this clause may result in immediate suspension or permanent disconnection of the Service.
d. The CPE router and SIM card are digitally paired and locked for exclusive use on the Halotel network and cannot be interchanged or used with other devices.

9. Right to Modify, Suspend, or Terminate Service

a. Halotel reserves the right to modify, suspend, or terminate the Service in whole or in part under the following circumstances:
i) When the customer engages in unauthorized or fraudulent use of the Service
ii) When the customer causes harmful interference or breaches Halotel’s network standards;
iii) When required by law, government order, or regulatory instruction;
iv) For technical maintenance, upgrades, or network security reasons.
b. Halotel may change these Terms or modify Service offerings from time to time to reflect operational or regulatory changes, with reasonable notice to customers.

10. Payments and Refunds

a. All Service charges are inclusive of VAT.
b. Payments for data plans or Service packages are non-refundable once activated.
c. Non-payment or expiry of validity automatically results in suspension of the Service until renewed by the customer.

11. Device Support and Repairs

a. In the event of a device malfunction, the customer must contact Halotel Customer Care by dialing 100 or visit the nearest Halotel shop for assistance.
b. Repair timelines are subject to parts availability and the complexity of the fault.
c. Halotel shall not be liable for any loss or damage resulting from unauthorized repair or modification of the CPE router by the customer or third parties.
d. In cases where the CPE router is lost, stolen, or irreparably damaged, the customer shall be liable to pay a replacement fee equivalent to the retail value of TZS 200,000.
e. The replacement fee must be settled before a new router is issued or before the service can be reactivated.

12. Limitation of Liability

a. Halotel shall not be liable for:
i) Service interruptions caused by circumstances beyond its control (including power outages, network upgrades, or natural disasters);
ii) Any indirect, incidental, or consequential losses arising from use or inability to use the Service;
iii) Degradation of Service due to customer misuse, relocation, or external interference.

13. Warranty

a. This warranty covers the device for a period of 24 months from the date of purchase.
b. The warranty applies to devices purchased from Halotel authorized outlets, agents, or distributors.
c. The warranty covers manufacturing defects in materials or workmanship under normal use.

14. Governing Law

a. These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the United Republic of Tanzania.
b. Any dispute arising hereunder shall be subject to the jurisdiction of competent courts or regulatory bodies within Tanzania.

15. Customer Acknowledgment

By subscribing to or using the Halotel 5G Fixed Internet Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
